The FMA has received several emails from physicians who are having issues with pharmacies that are refusing to fill prescriptions that are not submitted electronically. While there are state and federal laws that require physicians to e-prescribe, they do not completely ban the use of paper prescriptions or other non-electronic prescribing.
Read the FMA’s updateto learn about the legal requirements for e-prescribing, applicable exceptions, and effective dates.
If you are a physician who has encountered a pharmacy refusing to fill a validly issued paper prescription, contact our General Counsel’s Office at legal@FLmedical.com and provide the following:
Information on the medication prescribed
The name and address of the pharmacy refusing to fill the prescription
The state or federal exception that allows non-electronic prescribing in this instance
Please do not include any patient-identifying information.
