RPA Comments on Anti-Kickback Statute Address ESRD Telehealth Technologies, Nutritional Supplements

On October 24, RPA submitted comments to the HHS Office of Inspector General in response to a Request for Information (RFI) on its anti-kickback statute (AKS) and beneficiary inducements civil monetary penalties (CMP). RPA urged the OIG to establish a safe harbor for nutritional supplements, take a broad view in defining allowable telehealth technologies for use by patients (i.e., allowing the use of tablets), and called for exceptions to the AKS pertaining to innovative revenue distribution models in Medicare Shared Savings Plans (MSSPs) and other alterative payment models (APMs).
